This document applies to all participants, spectators, volunteers, and attendees (“You”) of events operated by Anywherefit (“Organizer”).
By registering for, attending, or participating in the Event, you acknowledge and agree to the policies outlined below.
1. REFUND & TRANSFER POLICY
1.1 Registration Fees
All registration fees are non-refundable, except where required by applicable California law.
Registration fees cover event planning, staffing, venue costs, equipment, and operational expenses incurred well in advance of the Event.
1.2 Event Modifications, Postponement, or Cancellation
Organizer reserves the right to modify, postpone, or cancel the Event due to circumstances beyond reasonable control, including but not limited to:
Weather conditions
Public safety concerns
Venue restrictions
Government orders
Acts of God or force majeure events
If the Event is postponed or modified:
Registrations may be transferred to a rescheduled date at Organizer’s discretion.
Refunds will not be issued unless required by law.
If the Event is canceled entirely:
Organizer may offer a deferral, credit, or partial refund at its sole discretion, subject to incurred costs and legal requirements.
1.3 Participant Transfers
Transfers to another individual may be permitted only if explicitly allowed by Organizer and completed by the stated transfer deadline.
Transfer fees may apply.
Unauthorized transfers are void and may result in disqualification without refund.
1.4 Division Changes
Requests to change divisions may be permitted prior to a designated cutoff date and are subject to availability.
No division changes will be allowed after the posted deadline.
1.5 No-Show Policy
Failure to attend, compete, or complete the Event for any reason—including injury, illness, travel issues, or personal circumstances—does not entitle the participant to a refund or credit.
2. SPECTATOR DISCLAIMER & ASSUMPTION OF RISK
2.1 Spectator Acknowledgment
Spectators acknowledge that the Event involves physically demanding athletic activities that may present risks to bystanders, including but not limited to:
Athletes moving at high speed
Dropped or thrown equipment
Loud music and crowd conditions
Environmental and weather-related factors
2.2 Assumption of Risk
By attending the Event, spectators voluntarily assume all risks associated with being present at a competitive fitness environment, whether inside or outside designated viewing areas.
2.3 Release of Liability
To the fullest extent permitted under California law, spectators agree to release and hold harmless:
Event Organizer
Venue owners and operators
Sponsors, affiliates, staff, and volunteers
from any claims arising from attendance at the Event, except where prohibited by law.
2.4 Minors
Spectators under 18 must be supervised by a parent or legal guardian at all times. Guardians assume full responsibility for minors under their care.
3. JURY TRIAL WAIVER & ARBITRATION AGREEMENT
3.1 Jury Trial Waiver
To the fullest extent permitted by law, YOU AND ORGANIZER EACH WAIVE THE RIGHT TO A TRIAL BY JURY for any dispute, claim, or cause of action arising out of or relating to the Event, these policies, or participation or attendance at the Event.
3.2 Agreement to Arbitrate
Any dispute, claim, or controversy arising out of or relating to:
Event participation or attendance
Registration or fees
Injury or damages
These policies or any other Event-related terms
shall be resolved exclusively by binding arbitration, rather than in court, except where prohibited by California law.
3.3 Arbitration Process
Arbitration shall be conducted in the State of California.
Arbitration shall be administered by a recognized arbitration provider (e.g., AAA or JAMS).
Arbitration shall be conducted on an individual basis only.
3.4 Class Action Waiver
You agree that:
Claims must be brought in your individual capacity
You waive the right to participate in any class, collective, or representative action
3.5 Governing Law
This agreement shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
3.6 Severability
If any provision of this section is found unenforceable, the remaining provisions shall remain in full force and effect.
4. ACKNOWLEDGMENT & ACCEPTANCE
By registering for, attending, or participating in the Event, you confirm that you:
Have read and understood this document
Agree to all terms and policies contained herein
Understand that participation and attendance involve inherent risks
