TERMS OF SERVICE

These Terms and Conditions (“Terms”) govern participation in and use of the website, registration system, and event services (collectively, the “Event”) operated by [Anywherefit] (“Organizer,” “we,” “us,” or “our”).

By registering for, attending, or participating in the Event, you agree to be bound by these Terms.

1. Event Participation & Eligibility

  • Participants must meet all eligibility requirements specified for their selected division.

  • Participants acknowledge that the Event involves physically demanding activities and confirm they are in adequate physical condition to participate.

  • Participants are solely responsible for ensuring they meet all medical, training, and safety requirements prior to participation.

2. Assumption of Risk

Participation in the Event involves inherent risks, including but not limited to:

  • Physical exertion

  • Injury, illness, or death

  • Equipment failure

  • Weather conditions

  • Contact with other participants or spectators

By participating, you voluntarily assume all risks, known and unknown, associated with the Event.

3. Waiver & Release of Liability

To the fullest extent permitted under California law, participants agree to release, waive, and hold harmless:

  • The Event Organizer

  • Venue owners and operators

  • Sponsors and affiliates

  • Volunteers, contractors, and staff

from any and all claims, liabilities, damages, or causes of action arising from participation in or attendance at the Event, except where prohibited by law.

4. Medical Responsibility

  • Participants acknowledge they are solely responsible for their own health and medical care.

  • Organizer is not responsible for medical expenses incurred before, during, or after the Event.

  • Participants consent to emergency medical treatment if deemed necessary by Event staff or medical personnel.

5. Registration, Fees & Refunds

  • All registration fees are non-refundable, except where required by law.

  • Organizer reserves the right to modify, postpone, or cancel the Event due to circumstances beyond reasonable control (including weather, safety concerns, or force majeure).

  • If the Event is postponed or modified, registration may be transferred to a future date at Organizer’s discretion.

6. Event Modifications

Organizer reserves the right to:

  • Modify the Event schedule, course, format, or divisions

  • Adjust heat assignments or start times

  • Remove participants for safety or rule violations

7. Conduct & Disqualification

Participants agree to:

  • Follow all Event rules, instructions, and safety guidelines

  • Conduct themselves in a respectful and sportsmanlike manner

Organizer reserves the right to disqualify or remove participants for unsafe behavior, misconduct, or failure to follow instructions, without refund.

8. Photography, Video & Media Release

By participating, you grant Organizer the irrevocable right to:

  • Photograph, record, and use your name, image, likeness, and voice

  • Use such media for promotional, commercial, or educational purposes

No compensation is owed for such use.

9. Intellectual Property

All Event branding, logos, content, and materials are the property of the Organizer or its partners and may not be used without prior written consent.

10. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes shall be resolved in a court of competent jurisdiction located in California.

11. Acceptance

By registering for or participating in the Event, you acknowledge that you have read, understood, and agree to these Terms.
